Welcome to the WOOOW AI platform ("Service"). These Terms and Services ("Terms") constitute a legally binding agreement between Tech Gaint Solution Private Limited (registered under the MCA) and you ("User," "you," or "your"). Please read these Terms carefully before accessing or using our Service.
By accessing, using, or subscribing to the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.
1. Description of Service
WOOOW AI is an AI Content Creation Application that provides users with a single platform to utilize various AI open source models (e.g., OpenAI, Deepseek, Grok, Gemini, Perplexity) and integrated third-party tools (e.g., clipdrop, heyGen, Novita, synthesia, Fal AI, etc.).
The Service includes:
- Access to diverse AI models and content creation tools.
- Marketing Bots for bulk message marketing on WhatsApp and Telegram.
- Social media marketing tools for platforms like Facebook, Instagram, X (Twitter), and LinkedIn.
- Access to stock media libraries (Unsplash, Pexels, Pixabay).
2. Account and Subscription
2.1 Account Creation
To use the Service, you must have a valid WOOOW AI account. The information you provide during account creation must be true, accurate, current, and complete.
2.2 Subscriptions
The Service is provided on a subscription-based model. You will only gain access after payment is successfully processed for your chosen subscription plan. All fees are payable in advance and are non-refundable, unless expressly stated otherwise in these Terms.
2.3 Security
You are responsible for maintaining the confidentiality of your account information. You are fully responsible for all activities that occur under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Rules of Use and Restrictions
3.1 Permitted Use
The Service is designed for Digital Agencies, Developers, Entrepreneurs, Copywriters, Digital Marketers, and Small and Medium-sized Businesses. You may use the Service only for lawful and ethical business purposes.
3.2 Prohibited Activities
You agree not to engage in the following activities:
- Illegal Activity: Using the Service for any unlawful or fraudulent purpose, including the violation of Indian laws or applicable international laws.
- Spamming/Abuse: Using the marketing bots for unsolicited bulk messaging (spam) or harassing users. You must comply with the terms of service of all social media platforms you utilize.
- Intellectual Property Infringement: Creating or distributing content that infringes upon the copyrights, trademarks, or other intellectual property rights of any third party.
- Platform Misuse: Attempting to gain unauthorized access or interfering with the Service; uploading viruses, malware, or harmful code; or disrupting the normal operation of the platform.
- Third-Party Terms Violation: When utilizing integrated AI models (like OpenAI, Gemini) or tools (like Unsplash, Pexels), you agree to comply with the separate terms of use and policies of those third-party providers.
3.3 Responsibility for AI Content
WOOOW AI facilitates content generation through various AI models. This content is not human-verified. As a User, you are:
- Solely responsible for all content, inputs, and outputs generated using your account.
- Required to verify the accuracy, legality, and suitability of any generated output before using it.
- Agreeing to indemnify and hold Tech Gaint Solution Private Limited harmless from any errors or faults in the content you create.
4. Affiliate Marketing Program
4.1 Nature of the Program
WOOOW AI offers a direct product referral Affiliate Marketing Program. This program allows users to earn a commission by sharing their personal referral links after using the platform.
4.2 Prohibition on Misrepresentation
This program is NOT Multi-Level Marketing (MLM), Network Marketing, a Binary System, a Pyramid Scheme, or a Ponzi Scheme. You must not promote it as such and must not engage in the following:
- Promoting "get-rich-quick schemes" or guaranteeing easy financial gains.
- Using financial greed as the primary attraction in any promotional campaign or corporate meeting.
- Misrepresenting the Company's business model or the nature of the commissions.
4.3 Commission Entitlement
Commissions are earned strictly based on valid referrals that meet the Company's specified criteria. The Company reserves the right to modify or terminate the Affiliate Program terms at any time.
5. Intellectual Property Rights
5.1 Company Property
The names, logos, platform design, software, and all integrated tools of Tech Gaint Solution Private Limited and WOOOW AI are the intellectual property of us and our licensors. These rights are protected by international copyright, trademark, and other intellectual property laws.
5.2 User Content
You retain ownership of the content you create using WOOOW AI. However, to the extent necessary to provide and improve the Service, you grant us a worldwide, royalty-free license to use, host, store, reproduce, and modify your content.
6. Disclaimer of Warranty
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Tech Gaint Solution Private Limited makes no warranties or guarantees that:
- The Service will be uninterrupted, error-free, or secure.
- The results obtained from the use of the Service will be accurate or reliable.
- The Service will be available at any particular time to meet your needs.
We believe our technology provides a right solution, but we do not guarantee specific business outcomes or financial success.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Tech Gaint Solution Private Limited, nor its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, whether incurred directly or indirectly.
Our aggregate liability for all claims arising under or related to these Terms shall not exceed the amount you paid for the Service in the twelve (12) months immediately preceding the event giving rise to the liability.
8. Indemnification
You agree to indemnify and hold harmless Tech Gaint Solution Private Limited and its directors and employees from and against any and all claims, liabilities, damages, costs, and reasonable legal fees arising from:
- Your breach of these Terms.
- Your violation of any third-party rights or laws.
- The content you create or upload.
- Any legal action resulting from your misuse of the marketing tools or spamming activities.
9. Changes and Termination
9.1 Modification of Terms
The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will attempt to provide reasonable notice before any material changes take effect. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
9.2 Termination
We may suspend or terminate your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Ranchi, India.
